Draft Notification of the Department of Industrial Works Re: Schedule for Public Hearing on the Principles of the Draft Notification of the Ministry of Industry Re: List of Hazardous Substances (No. ..) B.E. ….

Background

The Organization for the Prohibition of Chemical Weapons (OPCW) document S/1820/2019, dated December 23, 2019, notified the approval of adding 4 chemicals to Schedule 1 of the Annex on Chemicals to the Chemical Weapons Convention, items 13 – 16 [Link]. This was based on the resolution of the 24th Session of the Conference of the States Parties (CSP-24) on November 27, 2019, and has come into effect for States Parties on June 7, 2020.

During meeting No. 1/2021 on March 25, 2021, the National Coordinating Committee for the Implementation of the Chemical Weapons Convention resolved to approve the 4 chemicals added to Schedule 1A (Toxic Chemicals) of the Annex on Chemicals under the Chemical Weapons Convention as Type 4 Hazardous Substances under the responsibility of the Department of Industrial Works.

Currently, hazardous substances controlled under the Chemical Weapons Convention appear in both List 5.1 and List 5.5 annexed to the Ministry of Industry Notification Re: List of Hazardous Substances B.E. 2556 and its amendments. Therefore, it is deemed appropriate to amend and update the categorization of hazardous substances that are controlled chemicals under the Chemical Weapons Convention.

Content of the Draft Notification of the Ministry of Industry Re: List of Hazardous Substances (No. ..) B.E. ….:

  1. Revoke 43 hazardous substances in List 5.1, as amended by the Notification Re: List of Hazardous Substances (No. 2) B.E. 2558 and (No. 7) B.E. 2565 (Chemicals under the Chemical Weapons Convention).

  2. Revoke the name of List 5.5 and replace it with “List 5.5 Controlled Substances under the Chemical Weapons Convention”.

  3. Add 1,378 hazardous substances to List 5.5, consisting of:

    • 43 hazardous substances transferred from List 5.1 according to item 1.

    • 4 additional controlled substances under the convention as Type 4 hazardous substances of the Department of Industrial Works, in accordance with the OPCW document S/1820/2019, totaling 144 items as follows:

      • Item 13:

        • P-alkyl (H or ≤C10, incl. cycloalkyl) N-(1-(dialkyl(≤C10, incl. cycloalkyl) amino))alkylidene(H or ≤C10, incl. cycloalkyl) phosphonamidic fluorides and corresponding alkylated or protonated salts

      • Item 14:

        • O-alkyl (H or ≤C10, incl. cycloalkyl) N-(1-(dialkyl(≤C10, incl. cycloalkyl)amino))alkylidene(H or ≤C10, incl. cycloalkyl) phosphoramidofluoridates and corresponding alkylated or protonated salts

      • Item 15:

        • Methyl-(bis(diethylamino)methylene)phosphonamido fluoridate

      • Item 16:

        • Carbamates (quaternaries and bisquaternaries of dimethylcarbamoyloxypyridines)

        • Quaternaries of dimethylcarbamoyloxypyridines: [1-[N,N-dialkyl(≤C10)-N-(n-(hydroxyl, cyano, acetoxy)alkyl(≤C10)) ammonio]-n-[N-(3-dimethylcarbamoxy-α-picolinyl)-N,N-dialkyl(≤C10) ammonio]decane dibromide (n=1-8)]

        • Bisquaternaries of dimethylcarbamoyloxypyridines: [1,n-Bis[N-(3-dimethylcarbamoxy-α-picolyl)-N,N-dialkyl(≤C10) ammonio]-alkane-(2,(n-1)-dione) dibromide (n=2-12)]

    • 1,191 chemicals with CAS numbers of all substance groups controlled under the Chemical Weapons Convention, based on the Handbook on Chemicals 2024 [Link].
