Public Hearing on the Draft Notification of the Ministry of Industry Regarding the Bio Complex

Hearing Period: August 6 – September 6, 2026

Key Background: This draft notification stems from a Cabinet resolution approving the 10 target industries proposed by the Ministry of Industry, which include:

  • 5 First S-Curve Industries

  • 5 New S-Curve Industries

This initiative incorporates the Bioeconomy, which aims to add value by utilizing Thailand’s high-potential biological resources and agricultural raw materials. The goal is to create a sustainable production base for goods and services across all economic sectors. This will serve as a crucial mechanism for developing new target industries with the potential to drive the country’s economy forward. However, the transition toward high-value bio-industries still faces significant obstacles within the supply chain structure.

Therefore, to stimulate the government’s policy of developing New S-Curve industries and to build the foundational and supportive elements necessary for high-value bio-industries to develop and grow efficiently, it is deemed appropriate to promote the establishment of factory operations structured as a Bio Complex.

Key Provisions:

  1. This Notification shall come into effect on the day following the date of its publication in the Royal Gazette.

  2. This Notification shall not apply to factory operations under the factory laws for the types or categories of factories specified in Clause 5 that are not located within a Bio Complex according to this Notification.

  3. Definitions within this Notification:
    “Bio-industry” means an industry that processes biological resources and agricultural products using biotechnology to create high-value products in the bio-plastics and bio-chemicals group, the bio-pharmaceuticals and biological products group, the bio-energy group, or the bio-food group.
    “Bio Complex” means an area where bio-industry factories are co-located with supporting bio-industry factories for the benefit of bio-industry factory operations.
    “Bio-industry Factory” means a factory under the factory laws that engages in factory operations related to the bio-industry.
    “Supporting Bio-industry Factory” means a factory under the factory laws that engages in factory operations which:
              (1) Must exclusively use domestic agricultural products, such as sugarcane, cassava, or oil palm (one or more), as raw materials.
              (2) Must sell its products, production by-products, or unused materials resulting from its factory operations to be used solely as main raw materials for a bio-industry factory or a supporting bio-industry factory located strictly within the same Bio Complex.

  4. The bio-industry across the bio-plastics and bio-chemicals group, the bio-pharmaceuticals and biological products group, the bio-energy group, and the bio-food group includes:
              (1) Bio-industry factories.
              (2) Supporting bio-industry factories.

  5. Factories under the factory laws, according to the types or categories listed in the annex of this Notification, shall be designated as bio-industry factories or supporting bio-industry factories within their respective groups (bio-plastics/bio-chemicals, bio-pharmaceuticals/biological products, bio-energy, or bio-food), subject to specified conditions.

  6. The Ministry of Industry shall promote the establishment of Bio Complexes in the Bangkok Metropolitan area and other provinces as necessary.

  7. In establishing a Bio Complex according to Clause 6, the Ministry of Industry may request various forms of support from other agencies.
